So what the fuck are we talking about then? And if you say you've been shorted an hour - you better show me how you were shorted that hour compared to working the exact same time frame in the office vs home.
The way it was explained to me was only put what you actively worked IE on calls, working on projects etc. not the total time spent in front of the computer.
Then you should report them for employment fraud as that's absolutely blatantly illegal. 100% clear, no gray area, illegal. Employers cannot do that. If you are at work, you get paid. Period. The amount of wiggle room on that is zero.

OK - but you said you spend 6.5 hours working on client calls - and .5 hours reading work email... that's 7 hours... Are you saying you're only going to be paid for 6.5 hours?

Your understanding makes your job far worse than any of us have understood it to be thus far. The upside is that you can now take any of their clients and they are powerless to stop you because you are being violated under slavery laws and are untouchable. All contracts with them are invalidated, there can be no concept like non-disclosure or non-compete because they aren't acting as legal employers.

That's illegal, reading email is work. Someone has to do it so other things can be done.
In some places (not many), even being ABLE to read your email makes you billable for that time. That's why some employers are not cutting staff off from messaging and emails when the end of the day comes around so that it is impossible for them to claim to have decided to read emails when they shouldn't.

You are in NY though. Nebraska is a completely shit market. But this seems impossibly bad. He's obviously way more qualified than all the people he's working with as a starting point!

I think this is the problem. "Work You Did" and "Billable Hours" can't be the same. There is work time that isn't billable to a customer (unless they are faking hours.) So if you only put the billable hours, there is an issue.

yeah sure - I would only mean his daily pay, who would ever expect his hourly to change? certainly not me..
I asked - does this equate to less pay (in regards to this exact situation - was implied) and he answered - not hourly, but over all, yes - but that's not true.
If we assume his normal hours are 8-5 with a 1 hour lunch, he'd get paid for 8 hours.
In this case he's claiming that he's getting paid less because he's home and worked 8-4 with a 1 hour lunch... Well since he's hourly - there would be no difference between being at work and working or being home and working - he only worked 7 hours, so he gets paid 7 hours.Now - all that said - he did further break that down into 6.5 billable and .5 to corporate email... now the question is - is the company going to try to say they don't have to pay him for that .5 for reading corporate email - which of course we know legally they can't do.

This is kinda a big thing for my boss - she doesn't want non salaried personal to have remote access to email to prevent anyone claiming they were working during non work designated times.

As for me - you're possibly right - but the idea of trading in always punching a clock for the possible little bit of OT, not worth it to me. Plus I can get comp time when I work more than normal, I'm happy with my situation.

Not failing at interviews, not even getting in the door.Then use a head hunting company to find positions for you. Certainly they would have a litany of potential openings that you could apply to.
