The whole point being to show that it's your availability that they are paying for, not just the time you are working on billable projects/break-fixes.
Although this encourages all kinds of problems like demanding that he do that all the time, and threatening to not pay for his time in the office, etc. They already know that he is like that at work, and they already don't care. This is aboiut them bullying and trying to steal from him, point blank. This isn't a confused manager who doesn't understand the law, this is a crook trying to pad his wallet because he thinks IT guys are easy to push around (and often, they are.)
Well - the one asshat who thinks he's in charge does - but as Will pointed out - apparently the real boss has stepped up recent and put the fake boss in his place as a non boss - we'll see how long that lasts.

I talked to his boss, and we came to the conclusion that I'm fine,He can't tell me dick about anything, and He seems to think he's in charge.

Hopefully they are seriously dealing with your "supervisor" because he attempted to get them into a lawsuit. I've had someone pull that on me once. Once. The entire staff walked out that day and the owner literally came running after us apologizing like crazy. They fired the guy on the spot and paid everyone to go home for the day as part of the apology. Because allowing that guy to stay in a supervisor role is just asking for problems now - everyone knows he's up to no good.

I also got some good news ; we may be adding a department of Strictly IT (NOT POS) to our company here in Omaha, which I will then but pulled out of POS and into the new department. Pending Sales of the service that is.

as far as "being told what to do" on a working level ; tasks, assignments, etc I can't say no to him . but as far as pay, time off, and Business related requests I can.

Something kinda seems broken there.. but I suppose separation of duties (those you just mentioned) aren't unusual. Still sucks you have to take orders from him.. he's clearly bad in any kind of leadership role there.
