Absolutely irrelevant. Why are you talking about this? Obviously that doesn't matter at all. What is the point of this conversation?
Ubiquiti has published publicly, end of story. There is nothing more to discuss. Your binding by the T&C, your knowledge of there being a T&C is of no consequence to anyone else.

Technically I don't think he's allowed to tell us about the T&C at all if he accepted it. He can't actually tell us because he had to agree not to discuss it. We did not so can do so freely.

It's like people who have classified clearance levels, they aren't even allowed to look at websites that have the posted classified links, or read news paper articles of/about them, etc...
That fact that he's participating in this conversation is probably against his T&C

Yeah, that's what I was trying to say. He agreed to terms that say he can't discuss it. We did not. We are totally free to do so as it is public. He, however, remains bound by the T&C regardless of if it is now public or not. Now would UBNT care? Of course not, but legally, the T&C could still bind him but it cannot, in any way, ever mind us as we did not agree to it or even know about it.

But before I was told of the T&C. If you are going to play the "when did you find out" game, the T&C came too late and from a non-official source with no authority to make us aware of the T&C. So technically, I'm still not aware if there is a T&C, only that someone feels that there is, and am under no obligation to seek it out and am not bound by it even if I find it and learn of it unless I go further and agree to it.
