You are missing that it's not Ubiquiti causing the problem here. We don't know why different places are listing these products, what we do know is that according to Ubiquiti, they are early release and not eligible for resale.
Do you really think B&H would be selling product that's not officially available?
I don't know what B&H does, but if they are like Amazon and NewEgg, they likely don't even know what is being sold on their website. The real question is - do you really think that B&H's website listing a product is highly relevant to determining if UBNT really released a product? If so, why when it doesn't mean anything from any other reseller of that nature.
Most large resellers like B&H are open marketplaces selling whatever people put there.
B&H is official reseller of Ubiquiti. So is Baltic Networks, both are listed when you hit find reseller on Aircube page.

That was the point. Apple has nothing to do with it because they would be the wrong channel. It's not a Ubiquiti product yet, it's not released. That makes it, in that sense, a product of the reseller in California.

@marcinozga Exactly, you don't have access because you aren't part of the beta program! Sign up for the beta program, and you will see endless posts about how these aren't ready for production and all kinds of people having the same exact RMA issues as you.
There's obviously something wrong in the distribution channel for all of these resellers to already have this product available.

You should try reversing the question. Your statement would require a law to exist in order for it to be true. You are claiming that some companies, regardless of you not being their customer, must accept an RMA from you or provide support. In order for that to be true, a law stating that they had to do that would have to be written.
In the absence of that law existing (it does not exist) then standard contract law applies which enforces the opposite. Only the contractually obligated parties in the transaction have any requirements. The terms of that obligation would come from the NewEgg Marketplace terms of service. You should look there to see if even your reseller has any support obligations, it's possible that you've waived those.

You have a conflict in the above statement. Either you claim a law exists and that it gives you the choice, or you can't have that choice. Claiming that you have that choice is claiming that a law exists.
So you have to choose. Is there a law that lets you choose like this, or isn't there? You can't have it both ways. With the absence of a law, the manufacture is not involved here as they didn't sell you anything.

B&H is official reseller of Ubiquiti. So is Baltic Networks, both are listed when you hit find reseller on Aircube page.
Again, show me official documentation that says this product is still beta. Picture in online store doesn't say a thing, it's not a piece of documentation.We did. Now who is only reading what they want to read? Now you are taking UBNT's own website and claiming that it doesn't mean anything. Fine. Then provide a resource that is from no one but UBNT that says it has been released and that support is through UBNT not the reseller. You've not done that yet, we've provided what you asked for and you are refusing to take the one piece of documentation that UBNT has in any direction.
You don't like that it says beta for the product. Okay, but it never says that it is released. So we are back to - it's not released yet.

Can't state this enough times - what does this have to do with anything? And did you buy it from one of them? And if so, why didn't they handle the RMA for you like they are supposed to?

No, it's not your option. Period. You can't just make up options as to who has to do your RMA. That's not something that you as a buyer get to do.

Well, yes, actually, it is. It's just a normal part of contract law.

It's stock contract law. Like I said, as you are claiming a law exist that does not, you must provide the law that changes the de facto situation. Otherwise, de facto applies.
I'm not claiming that the law exist, I said it was my option to chose whether to go through reseller or directly to manufacturer. Ubiquiti has everything to do with the product, since they are the manufacturer. This isn't OEM product, it's Ubiquiti brand.
Actually, no, it is not. And I clearly linked to you the terms and conditions stating as much. Just because you got scammed does not mean that the terms and condition are invalid.
But it DOES mean that you can go after the reseller. But the issues here are between you and the reseller. UBNT is an innocent third party that isn't involved. They didn't make a product for sale, they didn't sell to you, they didn't interact with you.

In @marcinozga's defense, BH Photo and Baltic Networks are both authorized resellers and they both do have the product available. Definitely seems like a distribution error here.

I don't do business with either of them, I don't know how trustworthy either is, or if they are like Amazon and NewEgg and list third party stuff and only take it down when people complain.
