Why why does the 2 years matter?

Because the non-compete that they are abusing was for two years.

            That's certainly how it feels.

I was using my movie trailer announcer guy voice for that post... it might make a great film.

What in the world?!? How is that even possible by a corporation? Every person or lawyer I've talked to about any non compete I signed or was going to sign all said that non competes are unenforceable anyway if it would cause you not to earn a reasonable wage. Sounds like a bad one. Welcome back!

I had an attorney, too. Non-competes when written correctly are quite enforceable and when you are dealing with big budget companies, enforceability is not the concern. Because they sue companies that try to hire you, they make you effectively unemployable and can effectively bar you from working, which effectively bars you from maintaining a counter suit, which effectively makes the non-compete. Because the US does not protect your right to work, it allows a lawsuit, even a false one, to stop your ability to be employed. The US legal system always favours the suer, not the one being sued. And since, with enough money, you can make a lawsuit take longer than a viable working career length, you have effectively unlimited power, if the money is right, to block employment in the US regardless of legality.

Stopping you from earning a reasonable wage is hard to deal with when they can tie up the process longer than you can go without eating. When you deal with companies with essentially unlimited funds, all kinds of things change.

As I was reading your response, I said I guess anything is possible if they bury you in litigation costs. Money trumps even human decency most of the time. Such a shame.

Well that sucks. I guess it's another good reason to stay away from those companies.

Congrats on being employable again though.
Must be a nice feeling to have that option back.
